1. General

These Terms & Conditions apply to all services provided by Kitesurf Mindoro, including but not limited to:

• accommodation,

• kitesurfing lessons,

• wingfoil lessons,

• equipment rental,

• tours,

• camps,

• transport services,

• and other related activities.

By booking or participating in any service, guests agree to these Terms & Conditions.

2. Participation at Own Risk

Participation in all water sports and outdoor activities is entirely at the guest’s own risk.

Guests confirm that they:

• are physically fit,

• can swim,

• are aware of the risks associated with water sports and tropical environments.

Kitesurf Mindoro is not liable for:

• injuries,

• accidents,

• illness,

• loss of personal belongings,

• or damages occurring during participation,
  except in cases of gross negligence or intentional misconduct.

3. Weather & Wind Conditions

Kitesurfing and water sports activities depend on weather and natural conditions.

Kitesurf Mindoro does not guarantee:

• wind,

• waves,

• lesson progression,

• or specific riding conditions.

Bad weather, lack of wind, storms, rain, or force majeure do not automatically entitle guests to refunds.

4. Equipment Rental

Guests are fully responsible for all rented equipment during the rental period.

Any loss or damage caused by:

• negligence,

• misuse,

• unsafe handling,

• or riding outside recommended conditions

must be compensated by the guest.

Equipment must be returned in the same condition as received, excluding normal wear and tear.

5. Electronic Devices & Fire Safety

Guests are responsible for the safe handling and charging of all personal electronic devices including:

• phones,

• power banks,

• chargers,

• batteries,

• laptops,

• cameras,

• drones,

• and similar devices.

Guests must not leave charging electronic devices unattended for extended periods.

Guests are liable for damages caused by:

• overheating,

• malfunctioning,

• defective,

• or improperly used electronic devices.

Kitesurf Mindoro reserves the right to prohibit the charging or storage of devices considered unsafe.

6. Liability for Property Damage

Guests are liable for damages caused to:

• accommodations,

• buildings,

• furniture,

• equipment,

• boats,

• vehicles,

• or third-party property

if caused intentionally, negligently, or through improper use.

Guests are strongly advised to maintain valid liability insurance covering international travel and sports activities.

7. Accommodation Rules

Guests agree to:

• respect other guests and staff,

• comply with safety instructions,

• avoid excessive noise,

• and treat the property responsibly.

Kitesurf Mindoro reserves the right to terminate accommodation or activities without refund in cases of:

• dangerous behavior,

• intoxication,

• violence,

• harassment,

• drug use,

• or serious rule violations.

8. Bookings & Payments

Bookings are confirmed only after receipt of the agreed deposit or payment.

Remaining balances must be paid upon arrival unless otherwise agreed.

Kitesurf Mindoro reserves the right to cancel bookings in cases of:

• non-payment,

• operational necessity,

• force majeure,

• or safety concerns.

9. Cancellation Policy

Deposits are generally non-refundable unless otherwise agreed in writing.

No refunds will be provided for:

• early departure,

• missed lessons,

• weather conditions,

• transportation delays,

• illness,

• or personal reasons.

Rescheduling or credits may be offered at the discretion of Kitesurf Mindoro.

10. Insurance

Guests are strongly advised to obtain:

• travel insurance,

• accident insurance,

• health insurance,

• and personal liability insurance.

Kitesurf Mindoro does not provide personal insurance coverage for guests.

11. Force Majeure

Kitesurf Mindoro shall not be liable for cancellations, delays, damages, or service interruptions caused by events beyond reasonable control, including:

• storms,

• typhoons,

• earthquakes,

• pandemics,

• government restrictions,

• transportation disruptions,

• or power outages.

12. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of the Philippines.

Any disputes arising from services provided by Kitesurf Mindoro shall fall under the exclusive jurisdiction of the competent courts of the Philippines.

13. Severability

If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

14. Acceptance

By booking accommodation, participating in activities, renting equipment, or using services provided by Kitesurf Mindoro, guests confirm that they have read, understood, and accepted these Terms & Conditions.
